2. Scope and acceptance
2.1These Terms and Conditions (the “Terms”) govern the use of the Eveon mobile application, the website eveon.ma, and the electric vehicle charging stations connected to the Eveon platform (together, the “Service”).
2.2By creating an account, topping up a wallet, or starting a charging session, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
2.3These Terms apply to drivers who use the Service to charge a vehicle (“Users”). Businesses that use the Eveon platform to manage their own charging stations (“Operators”) are bound by a separate written agreement. Where that agreement conflicts with these Terms, the agreement prevails.
2.4When you create your account, we send you a confirmation by email that includes these Terms, the main information about the Service and how to exercise your right of withdrawal, so that you can keep a copy.
3. Your account
3.1You must be at least 18 years old and able to enter into a binding contract under Moroccan law to create an account.
3.2You agree to give accurate information when you register and to keep it up to date.
3.3You are responsible for keeping your login details confidential and for all activity on your account. Tell us immediately at contact@eveon.ma if you believe your account has been used without your permission.
3.4One person may hold only one account. Accounts cannot be transferred or sold.
4. The Eveon app
4.1The Eveon app lets you find charging stations, see the price before you charge, start and stop a session by scanning the QR code on a station, top up your prepaid wallet, and view your charging history and receipts.
4.2You need a compatible smartphone, an internet connection and the latest version of the app to use the Service. Mobile data costs are your responsibility.
4.3We may update the app to improve it, fix errors or meet legal requirements. Some features may not work on older versions.
5. Prepaid wallet
5.1All payments for the Service are made from a prepaid wallet in your Eveon account. You must have enough balance before you start a session.
5.2You can top up your wallet using the methods shown in the app, and the funds are held in accordance with the rules that apply to it. The minimum top-up is 50 MAD. Bank card payment at the charging station is not available for the moment.
5.3Your wallet balance is held in Moroccan dirhams (MAD). It earns no interest and cannot be transferred to another account.
5.4You can ask for a refund of your unused balance at any time by writing to contact@eveon.ma. We will refund it within 90 days, minus any amounts still owed for sessions.
5.5If your account stays inactive for [24] months, we will contact you before taking any action on a remaining balance.
5.6Right of withdrawal. Under Law No. 31-08 on consumer protection, you have 7 days from the creation of your account to withdraw from this contract, without giving a reason and without penalty, by writing to contact@eveon.ma. If you withdraw, we refund all amounts you have paid, minus any charging sessions you have already used. By starting a charging session within these 7 days, you expressly ask us to provide the service immediately and you lose the right of withdrawal for that session. In any case, your unused wallet balance remains refundable at any time as set out in section 5.4.
6. Pricing
6.1Eveon charges for the use of the charging service, based on the time your vehicle is connected to the charging point. Prices are set per minute in MAD, including taxes.
6.2The price per minute for each station is shown in the app before you start a session. Prices may differ between stations, power levels and times of day.
6.3Some stations may charge an additional per-minute fee if your vehicle stays connected after charging has finished (“idle fee”). If this applies, it is shown in the app before you start.
6.4We may change prices at any time. A change never applies to a session already in progress.
6.5After each session, the app shows its duration and total cost, and an electronic receipt is available in your history.
7. Charging sessions
7.1To start a session, scan the QR code on the station with the Eveon app and start the charging session. To end it, stop the session in the app or follow the instructions on the station.
7.2The amount is deducted from your wallet at the end of the session. If your balance runs out, the session stops automatically.
7.3Charging speed depends on your vehicle, the station, the electrical capacity available on site and how power is shared with other vehicles (load balancing). We do not guarantee a specific charging speed or charging time.
7.4If a session is interrupted by a fault on our side, you only pay for the minutes actually used. Report any billing error within [30] days through the app or at contact@eveon.ma.
8. Your obligations when charging
8.1Use the stations only to charge an electric or plug-in hybrid vehicle that is compatible with the connector, using approved cables in good condition.
8.2Follow the instructions on the station and in the app, and the rules of the car park or site where the station is located (opening hours, parking fees, time limits).
8.3Do not damage, open, modify or misuse a station, and do not block a charging bay when you are not charging.
8.4Report any damage, fault or danger immediately through the app. In an emergency, stop using the station and contact the emergency services.
8.5You are responsible for any damage you cause to a station or to the site through misuse or negligence.
9. Availability of the Service
9.1We work to keep the app and stations available at all times, but we cannot guarantee uninterrupted service. Stations may be unavailable because of maintenance, faults, power cuts, network outages, or because they are in use.
9.2Station availability shown in the app is for information only. We do not guarantee that a station will be free or working when you arrive, unless a reservation feature is offered and confirmed in the app.
9.3We may carry out maintenance on the platform or the stations, where possible outside peak hours.
10. Liability
10.1We are responsible for providing the Service with reasonable care and skill, in line with Moroccan law, including Law No. 31-08 on consumer protection.
10.2We are not responsible for: damage caused by a vehicle, cable or equipment that is faulty or not compatible; your failure to follow these Terms or the instructions on the station; events beyond our reasonable control (such as grid failures, extreme weather or third-party network outages); or the rules, fees and security of the car park or site where the station is located.
10.3We are not liable for indirect losses, such as lost time, missed appointments or loss of income, except where the law does not allow this exclusion.
10.4Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited under Moroccan law.
11. Suspension and closure
11.1We may suspend or close your account, with notice where possible, if you breach these Terms, use the Service fraudulently, damage a station, or fail to pay amounts owed.
11.2You may close your account at any time from the app or by writing to contact@eveon.ma. Any remaining wallet balance will be refunded as set out in section 5.4.
12. Intellectual property
The Eveon name, logo, app, website and platform, and all their content, belong to EVEON SARL or its licensors. You receive a personal, non-exclusive, non-transferable right to use the app for its intended purpose. You may not copy, modify, resell or reverse-engineer any part of the Service.
13. Personal data
We process your personal data as described in our Privacy Policy, in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data.
14. Changes to these Terms
We may update these Terms to reflect changes to the Service or the law. We will tell you about important changes in the app or by email at least [15] days before they take effect. If you continue to use the Service after that date, you accept the new Terms. If you do not agree, you may close your account and ask for a refund of your balance.
15. Governing law and disputes
15.1These Terms are governed by Moroccan law.
15.2If you have a complaint, contact us first at contact@eveon.ma. We will reply within [15] working days and try to find an amicable solution.
15.3If no solution is found, and in accordance with Article 202 of Law No. 31-08 as amended by Law No. 78-20, you may bring the dispute before the court of first instance of your home or place of residence, or of the place where the event causing the damage occurred, at your choice. For disputes with Users who are not consumers, the competent courts of Tangier have jurisdiction.
15.4These Terms are available in Arabic, French and English. As required by Article 206 of Law No. 31-08, an Arabic version is always provided. In case of differences between versions, the [Arabic] version prevails.
